No Diya Ought To Be Given To The Family of Whoever Killed Himself
In the name of Allaah the Most Gracious, the Most Merciful. Prayers of forgiveness and peace be upon the seal of the prophets and messengers, Mohammed the messenger of Allaah, and his righteous and pure family and all the believers
Here is a response to questioners and a ruling with truth, and I truly do not say about Allaah except the truth; having said that, no diya (blood-money) ought to be given to the family of whoever killed himself, in line with the Word of Allaah the Exalted:
(وَلَا تَزِرُ وَازِرَةࣱ وِزۡرَ أُخۡرَىٰۚ وَإِن تَدۡعُ مُثۡقَلَةٌ إِلَىٰ حِمۡلِهَا لَا یُحۡمَلۡ مِنۡهُ شَیۡءࣱ وَلَوۡ كَانَ ذَا قُرۡبَىٰۤۗ إِنَّمَا تُنذِرُ ٱلَّذِینَ یَخۡشَوۡنَ رَبَّهُم بِٱلۡغَیۡبِ وَأَقَامُوا۟ ٱلصَّلَوٰةَۚ وَمَن تَزَكَّىٰ فَإِنَّمَا یَتَزَكَّىٰ لِنَفۡسِهِۦۚ وَإِلَى ٱللَّهِ ٱلۡمَصِیرُ)
[Surah Fatir 18]
{No bearer will bear the burden of any other person. If a person carrying a heavy load calls (someone) to (share) his load, nothing from it shall be carried (by the latter), even though he be a near of kin. You can warn only those who fear their Lord, while He is unseen, and establish Salāh. Whoever gets purified gets purified for his own benefit. And to Allaah is the final return.} 35:18
For instance, someone got into a car and sat in the passenger seat or at the back (seat or trunk), whether the driver was aware of his presence or not, and while the car was moving on its way he jumped out of it, hit the ground, and died; consequently, the driver of the car must not pay a penny of the blood money (Diya) as the diya of wrongful death in the clear verses of the Great Quran is the unintentional act by the murderer. On the other hand, if an adult passenger intentionally jumped off of a car while it was on the road it is considered an intentional suicide, or if a mischievous boy who was not kidnapped but willingly got into the car and did not ask the driver to pull over; instead, he jumped off of its back while it was moving then he hit the ground and died; then by what right does the driver bare the diya of the dead person?! As there is not any wrongful death caused by the driver in the case at all, but the one who destroyed himself is solely the dead person, since he is the one who intentionally jumped off of the car while it was moving or he was a mischievous boy. Who is it who gave a ruling about paying diya to the family of whoever throws himself intentionally off a car?! And according to the asker, the mischievous boy got into the trunk of the car without the driver notices, then he jumped out of the car while it was on its way and died, and I highlight this truth and say: even if the driver knew about the passenger's presence and he did not ask the driver to pull over to get out of the car but jumped out of it while it was moving, then this mischievous boy has killed himself and brought his doom on his own and the driver must not carry the boy's burden as he did not kill him
I wonder where exactly is the wrongful death caused by the driver in this case? As the blood money given to the family of the boy is based on the wrongful death caused by the driver! And I repeat: Where exactly does the act of wrongful death lie in this incident if you are fair? Now by which right do they let the driver pay blood money to the family of the mischievous boy or the suicided man while they did this to themselves and by themselves?! And no bearer of burdens will bear the burden of another, so in the clear verses of the great Quran you are not allowed to let the car driver bear the diya of the wrongful death, since in this raised-to-be-answered case I did not find that the driver did wrongfully kill anyone; but the case deals with either suicide or mischief and the driver is not guilty by an atom's weight
So be mindful of Allaah, o people of understanding minds and judge with what Allaah has Revealed in the Book. Certainly, the judgment of Allaah in the clear verses of His Book, the Great Quran, inevitably agrees with mind and reason since the mind, if used, would not restrict seeing the truth. To illustrate, you will always find the mind supporting truth and logic, as truth is always perceived by the mind and logically admitted by it. Surely, the mind is wisdom itself, in case mind is used, in line with the Word of Allaah the Exalted:
{ يُؤْتِي الْحِكْمَةَ مَن يَشَاءُ ۚ وَمَن يُؤْتَ الْحِكْمَةَ فَقَدْ أُوتِيَ خَيْرًا كَثِيرًا ۗ وَمَا يَذَّكَّرُ إِلَّا أُولُو الْأَلْبَابِ ﴿٢٦٩﴾ } [ البقرة ].
He gives wisdom to whoever wills, and whoever has been given wisdom has certainly been given much good. And none will remember except those of understanding.} 2:269
